1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and BulkForge ("Company," "we," "us," or "our") regarding your use of the BulkForge platform, website, and services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy.

2. Service Description

BulkForge is a SaaS platform that provides bulk content management and AI-powered content generation tools for WordPress and WooCommerce sites. Our Service includes:

• Bulk editing capabilities for posts, pages, and products
• AI-powered content optimization and generation
• Multi-site management tools
• Analytics and reporting features
• Workflow automation and approval systems

3. Account Registration and Security

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Be at least 18 years of age or have parental consent
• Not create an account using false or fraudulent information

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach.

4. Subscription Plans and Billing

4.1 Subscription Tiers

BulkForge offers multiple subscription tiers (Solo, Studio, Agency, Enterprise) with varying features, site limits, and credit allocations. Full pricing details are available on our pricing page.

4.2 Billing and Payment

• Subscriptions are billed monthly or annually in advance
• All fees are non-refundable except as required by law
• We use Stripe for payment processing; their terms also apply
• You authorize us to charge your payment method for all fees
• Failure to pay may result in service suspension or termination

4.3 Credits System

AI-powered features consume credits based on content volume (typically 10 credits per 1,000 words). Credits:

• Are allocated monthly based on your subscription tier
• Do not roll over to the next billing period
• Can be purchased in additional packs as needed
• Are non-refundable once consumed

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Generate or distribute illegal, harmful, or offensive content
• Infringe on intellectual property rights of others
• Attempt to reverse engineer, decompile, or hack the Service
• Use automated systems to access the Service beyond normal usage
• Resell or redistribute the Service without authorization
• Generate spam, malware, or phishing content
• Overload or disrupt our infrastructure

6. Content Ownership and Rights

6.1 Your Content

You retain all ownership rights to content you upload, create, or generate using the Service ("Your Content"). By using the Service, you grant us a limited license to:

• Store, process, and transmit Your Content as necessary to provide the Service
• Use Your Content to train and improve our AI models (anonymized and aggregated)
• Display Your Content back to you and authorized team members

6.2 AI-Generated Content

Content generated by our AI features is provided to you, and you are responsible for:

• Reviewing and verifying accuracy before publication
• Ensuring compliance with applicable laws and regulations
• Respecting intellectual property rights of third parties
• Any consequences of publishing AI-generated content

6.3 Our Intellectual Property

The Service, including all software, designs, text, graphics, and trademarks, is owned by BulkForge and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

7. Data Protection and Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data. Key points include:

• We use Supabase for secure data storage with encryption at rest
• We comply with GDPR, CCPA, and other data protection regulations
• We do not sell your personal data to third parties
• You have rights to access, modify, and delete your data

8. Service Availability and Support

8.1 Service Level

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may suspend the Service for maintenance, upgrades, or emergency repairs with reasonable notice when possible.

8.2 Support

Support levels vary by subscription tier. Enterprise customers receive priority support with 1-hour SLA. Studio and Agency plans receive support within 4 hours during business hours. Solo plans receive best-effort support within 24 hours.

9. Termination

9.1 By You

You may cancel your subscription at any time through your account settings. Cancellation is effective at the end of your current billing period. No refunds for partial periods.

9.2 By Us

We may suspend or terminate your access to the Service immediately if you:

• Violate these Terms or our Acceptable Use Policy
• Fail to pay fees when due
• Engage in fraudulent or illegal activities
• Pose a security risk to our systems or other users

9.3 Data After Termination

Upon termination, you have 30 days to export your data. After this period, we may delete your data from our systems. We are not responsible for data loss after termination.

10. Disclaimers and Limitations

10.1 Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULKFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless BulkForge, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) Your Content.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.

13. Governing Law and Disputes

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through:

14.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
